So I took my TH to a shop, and the guy told me that he couldn't find any structural damage, which is GREAT news!! Maybe I should take it to dealer??
Oh btw I should probably clarify...I was going 20-30 but then SLAMMED my brakes! so impact speed was much lower...it was right before my TH stopped

I called her and we are gonna meet up and take her car to the dealer to get an estimate on Monday so I guess we will find out the damage soon!!

It seems like insurance is for days like this eh?
Just gotta bite the bullet and go through it :/

A dealer's body shop is no better than any other body shop. If you got an opinion that there was no structural damage, and no air bags deployed, you are good to go.

I gave her the 200 dollars and made her sign a paper that said that closed any further claims on it. Well, I never heard anymore, but I probably could have had problems as my paper I had her sign was not probably legal anyhow. But I didn't hear anymore from her and that was probably over 20 years ago, but it sounds like yours is probably going to have to go through insurance.
Basically a non formal covenant not to sue as well as a release! Way to go. Glad you never heard from her

Okay..quick update....thanks everyone for your replies btw!! Really appreciate it!! 🤗
So she just called me and said she really doesn't wanna go through her insurance bc then her car max report will show that the vehicle was involved in an accident....she said she took it to a shop and they told her no damage was done besides the bumper dent which they can fix for $375. She told me to pay her this with PayPal....I said I can give you a check....in person...if you sign a auto collision claims release form....she said "oh absolutely"....
is it really possible that I don't hear from it again like this....hmmm.....

DO NOT DO THIS.

File a claim. I don't care what else you do. File a claim and let the insurance companies handle it. She can file a claim for diminution of value in most states. Just DO NOT DO THIS.

Also, unless you're an attorney, you're really not qualified to draft any kind of legally binding indemnification or release of liability. Just don't even try it, or you'll end up paying an attorney later. Why would you pay an attorney later? Because your insurance policy contains boilerplate language that warns you that your insurer can and will disclaim coverage if you fail to report a claim within XXX days and/or attempt to go avoid filing a claim by "working it out" yourself.

Trust me.

-Rob, Esq. (insurance defense attorney)

P.S. - this isn't legal advice (unless you're in Maryland or another jurisdiction where I'm admitted), but I identify my line of work to elucidate the fact that I know what I'm talking about.

...and while not an attorney, if I were buying a used car, I would like to know its history and not have previous collisions hidden from me. I would think that's something you would want as well...

Wow!! Thanks guys for the replies!!
I ended up telling her that it's better for both of us to go through insurance!! She said she really doesn't want to do it...bc her car value would go down...I said I'm sorry but I wouldn't want to buy a car that has been in an accident that I wouldn't know about...and my car would take the same hit...so imma just file a claim with my insurance! ) just gets rid of all headaches!
